Terms of Agreement

Draft for review · Not in effect

These proposed terms describe the use of Air POS by restaurants and other business customers. They cover the platform features included in your order, which may include point of sale, kitchen displays, reservations, online ordering, websites and Gordon AI. They do not replace a restaurant’s own terms with its guests.

The service

1.1Your agreement

Your order identifies the products, locations and authorised users covered by your subscription. The person accepting an order on behalf of a business must have authority to bind that business. These terms become binding only through the acceptance process specified in the final agreement.

1.2Resellers and commercial terms

Individual resellers set their own pricing. Your reseller agreement or order specifies fees, currency, taxes, billing arrangements, subscription duration and any hardware, onboarding or support services. Air POS does not publish a universal retail price. Confirm the contracting and billing parties in your order before purchasing.

1.3Platform and third-party services

Air POS and its licensors retain rights in the platform and its software. Your subscription permits use of the agreed services; it does not transfer ownership of the software. Optional payment, delivery and other integrations may have separate provider terms. Review those terms before enabling an integration.

Your responsibilities

2.1Accounts and authorised use

You are responsible for the accuracy of your account information, the people you authorise to use the service and the permissions you assign. Keep credentials secure and tell us promptly if you suspect unauthorised access. Do not use the platform unlawfully, interfere with its operation, access another customer’s data or bypass security controls.

2.2Your restaurant and your guests

You remain responsible for your menus, prices, taxes, allergen information, booking rules, promotions and the fulfilment of orders. Your restaurant’s terms should explain cancellations, refunds, delivery and reservations to guests. Using Air POS does not transfer your obligations to guests, employees or authorities to Air POS.

2.3Your content and domain

You retain ownership of the content you supply and your domain name. You grant Air POS permission to host, process and display that content as needed to deliver the services you request. You must have the necessary rights to the images, branding and other materials you upload. Domain configuration does not transfer domain ownership.

AI and data

3.1Gordon AI

Gordon can assist with content and operational tasks. AI-generated results can contain errors. Review proposed changes, prices, menus and other outputs before relying on them, and use appropriate permissions for actions that affect your business. Do not submit personal information that is unnecessary for the task. The final data-processing terms must identify the AI providers involved and their permitted uses of submitted information.

3.2Privacy and customer data

Each party must meet the data-protection obligations that apply to its activities. Where Air POS processes personal data on your behalf, a separate data processing agreement must describe the instructions, safeguards and responsibilities. The Privacy Policy explains processing for which Air POS determines the purposes and means. You are responsible for appropriate notices and a lawful basis for the personal data you provide.

Service availability and termination

4.1Availability and support

Maintenance, network conditions and third-party services can affect availability. Support hours, service levels and any remedies must be stated in your agreement. Keep appropriate operational contingency procedures for your restaurant. This draft does not promise uninterrupted service or a particular response time.

4.2Suspension, cancellation and termination

Renewal and cancellation arrangements are set out in your order or reseller agreement. The final agreement must specify when access may be suspended, the notice and opportunity to remedy a breach, and any refund rights. It must also explain how and when you can export data and when remaining data and backups will be deleted, subject to applicable retention requirements.
